"I,
President
of India, being the Appointing Authority of
Judges of Supreme Court and High Courts including
Chief Justices thereof; so also I being the Authority to
remove them as enshrined in Constitution of India and
being of the considered opinion that the alleged crimes;
reported in the web site which is substantiated
evidentially in the CD I have received from CIPCJI; committed
by Judges who are members of Fraud Judges Society; are
prima facie have evidence to show that the crimes in the
nature of corruption, conspiracy, cheating, contempt of
court, etc. are committed and I am satisfied.
Under the circumstances, as advised by
the "Council of Ministers headed by Prime
Minister " I, hereby, in
accordance with Section 14 and Section 21of
General Clauses Act of 1897 read with Article 367 of
Constitution of India, consent to the permission
seeked by CBI to prosecute the Judges of Supreme Court,
High Courts and other such Judges who may be in Service
by my Warrant of Appointment.
Concurrently it is also directed
that Govt. of India to keep me apprised of the courses
of actions the different ministries are
contemplating/initiated in the aforesaid Judges'
Scandal."

Resolutions Of Houses of Parliament Of India
This House is of the opinion that ILR 1995 KAR 3139 [027.05][027.05s][027.11s];
a Judgment delivered by High Court of Karnataka in 1995
against Public Interest Litigation, in which case Union
of India represented by Secretary to Law &
Parlimentary Affairs of India was Respondent; the case
be directed to be re-opened by Supreme Court and hear the
case based on actual facts of case and so also the case
be clubbed with SLP(Civil) No. 12153 of 2000 [026.22][026.22A
] filed by Fraud Judges Society.
This House is of the considered opinion that Justice
S. Rajendra Babu [056.02] who
is Chief Justice of India in-waiting, not to be
appointed as Chief Justice of India in the event of the
Office of the present Chief Justice of India becomes
vacant, due to the frauds he has perpetrated by
violating various laws and in contempt of various
judgements the Fraud Judges Society has taken of which
justice Rajendra Babu is a beneficiary as he having
built house on the site alloted by the Fraud Judges
Society in the controversial layout formed by Fraud
Judges Society in Bangalore.

This House is of the considered opinion that the lands
on which the controversial Judicial Layout is formed is
acquired by the Govt. of Karnataka in violation of
Parliamentary Act No. 68 of 1984 by Fraud and conspiracy
be hereby declared that the said land including the
buildings what-so-ever on that land measuring
approximately 193 acres be forfeited as an Illegally
Acquired Property. The "Appellate Tribunal of
Forfeited Property, New Delhi" be directed to
receive the property as the custodian. President of
India be requested to relieve Justice J. Eshwar
Prasad from Chairmanship of the Tribunal; in case if he
does not resign owning moral responsibility as a party
to the crimes committed by the Fraud Judges Society due
to the fact that he happens to be member of the Fraud
Judges Society.

This House is of the considered opinion that Ministry
of Agriculture be ditected to collect, compile &
place an White Paper detailing the Implimentation &
working of "Parliamentary Act
No.68 of 1994 Vis-a-Vis Acquisition of Lands
(belonging to Agriculturists) for Private Companies
(including Housing Societies) in Karnataka since
September24,1984" .

This House is of the considered opinion that MINISTRY
OF LAW, JUSTICE AND COMPANY AFFAIRS (Department of
Justice) by its RESOLUTION dated 21st March, 1996 [055.01]
had constituted First National Judicial Pay Commission [055.00]
in part performance of implementation of Supreme Court
directions arising out of All India Judges Association
but on the contrary the other part of performance /
implementation of direction of court i.e. Setting up of
National Judicial Academy [055.02]
having not been set up it is Resolved that the aforesaid
Resolution be rescinded forthwith and further Resolve
that both First National Judicial Pay Commission and
National Judicial Academy be constituted / setup
simultaneously and until such time the recommendations
made by the said Pay Commission shall not be given
effect to. Top
This House is of the considered opinion that Govt. of
India should not give effect to the Recommendations made
by First National Judicial Pay Commission and President
of India be requested to relieve Justice K. Jagannatha
Shetty, Chairman, Former Judge, Supreme Court of India
and Justice A.B. Murgod (Retd.) Member Secretary in case
if they do not resign owning moral responsibility as
parties to the crimes committed by the Fraud Judges
Society due to the fact that they happen to be members
of the Fraud Judges Society. Top
This House is of the considered opinion that Joint
Parliamentary Committee be formed to investigate the
affairs of Fraud Judges Society and to identify and fix
the persons and Authorities who are responsible for the
crimes committed and being allowed to continue so far
& to find ways & means including Legislation to
curb such incidents surfing in future . This House
is of the considered opinion that Govt. of India should
Award & adore
"Centre
for Investigation & Prosecution of Corrupt Judges of
India" with
who have risked their Lives &
so also spent
Money-n-years investigating-n-compiling the Judges
Scam ; which act of this House will go Long
Way to communicate that Parliament, Govt. & CBI
shall support NGO's & others to fight
corruption & eradicate it.

In exercise of Article 32 of Constitution of India,
Justice R.C. Lahoti, The Chief Justice of India &
His Companion Judges [excluding Judges who are involved
in the Scam] of the Hon'ble Supreme Court is humbly
requested:
*To initiate the Criminal Contempt of Court proceedings
in accordance with Section 2 (c) of Contempt of Court
Act,1971 [041.05]
against the Society & its Members for having
committed acts in contempt of various judgments [501.00
] which they have procured to form the so called
Judicial Layout; the effect of which is to "abuse
the process of courts" "to lower the
dignity of courts" and "scandalizing or
tending to scandalize the high court of Karnataka"
and "Interfering and obstructing the administration of
justice of Karnataka High Court". The members
of the society who all claim to be the Judicial
Department ; who inter alia include present [a]
Supreme Court Judges [b] Retired Supreme Court Judges
[c] Most of the present High Court Judges [d] Most of
Retired High Court Judges retired between 1980 to 2002
[e] Law Secretaries to Government of Karnataka &
their Sub-Ordinates from Judicial Department [f]
District Magistrates of Karnataka [g] Lower Court Judges
Karnataka [h] Lok Ayukta & most of the Magistrates on
Deputation to Lok Ayukta etc., numbering about 2600
Employees of Judicial Department. [014]
* To direct CBI to initiate proceedings against the
Fraud Judges as per Sec.7, Sec.8, Sec.9, Sec.11,Sec.13,
and other provisions of The Prevention of Corruption
Act, 1988; for having failed to pay the Govt. demands as
per the Agreement entered between the Society and Govt.
on January 4th 1988 [005.01B][005.01][026.22][026.22A
] whereby the Society without paying the cost of lands
to the Govt. procured lands from Govt. with Fraud Judgments
with corrupt motives and in violation of
Terms of Agreement.
* To direct CBI to initiate proceedings against the
Fraud Judges as per Sec.7, Sec.8, Sec.9, Sec.11,Sec.13,
and other provisions of The Prevention of Corruption
Act, 1988; for having failed to pay the Govt. demands as
per the Agreement entered between the Society and Govt.
on January 4th 1988 [005.01B][005.01]
and the Society by Fraud suppressing this Agreement and
thereby failing to get the lands converted from
Agricultural to Residential use and thereby trying to
cheat Govt. of Rs.1 crore since 1989 [026.06][026.08][026.09][026.04][026.22][026.22A
].

* To direct CBI to initiate proceedings against the
Fraud Judges as per Sec.7, Sec.8, Sec.9, Sec.11,Sec.13,
and other provisions of The Prevention of Corruption
Act, 1988; for having failed to pay about Rs.5.50 lakhs
per acre x 200 acres = Rs. 11 crores which is legal
money the Society should have paid to Bangalore
Development Authority which is not paid; but on the
contrary 2600 sale deeds fraudulently [A107]
has registered claiming that BDA has approved layout

* To direct CBI to initiate proceedings against the
Fraud Judges as per Sec.7, Sec.8, Sec.9, Sec.11,Sec.13,
and other provisions of The Prevention of Corruption
Act, 1988; the Fraud Judges Society procured the judgment
against BDA and Sub-Registrar; in 1994
reported judgement as ILR 1994 KAR 2115 [025.13]
under which judgment the Society should have
Relinquished 50% of lands (about 100 acres) towards
roads, parks, civic amenity sites and open spaces, etc.;
but on the contrary the Society with corrupt motives in
Contempt of the said Judgment have converted the Civic
Amenity Sital area into about 500 illegal sites and are
shared among the Judges, Ministers, Govt. Officials
including Commissioners of Yelahanka City Municipal
Corporation (CMC) with conspiracy to defraud BDA and the
general public estimated of amount is as follows: 35% of
193 acres calculated to be misappropriated = 67.55
acres. Then 1 acre = 40 guntas, i.e. 40 guntas x 33 ft.
x 33 ft. = 43,560 sq. ft. is One acre. 43,560 sq.
ft x 67.55 acres x Rs.600 per sq. ft. =
Rs.176,54,86,800 (Rs. 176.5 crores) [ 040.02
]
*To recall all the orders, judgments directions issued
by High Court of Karnataka, any other court or authority
in relation to Fraud Judges Society. [501.00
]
*To reopen all the Fraud Judgments secured by Fraud
Judges Society [501.00 ]
and to proceed to hear the cases based upon the actual
facts which were prevailing at the relevant times / year
of the judgments and inter alia to proceed with the
cases in tune with "Skipper Construction Company
Vs. Delhi Development Authority" whereby to unveil
the veil of judiciary in the interest of enhancing
the confidence of the Public in courts and thereby to
maintain "the dignity and authority of Supreme Court".

*CBI be directed to seize the Office of the Fraud
Judges Society which is located in the High Court
premises in Bangalore.
*High Court of Karnataka be directed to cancel / rescind

from any private or govt. owned banks, institutions to
help the members of the Fraud Judges Society for
purchase of site or construction thereon in the
controversial Judicial Layout forthwith. To this effect
a Public Notice be also published in leading English and
Kannada newspapers of Karnataka.

Decisions of the Cabinet of ministers of Karnataka Advocate General be requested to initiate Contempt of
Court proceedings against the Fraud Judges Society and
the beneficiaries of Judicial Layout for having
committed Contempt of the judgment delivered by High
Court of Karnataka through Justice G.P. Shivaprakash
(who is member & has also built house) and procured
by Fraud Judges Society in 1994 reported as ILR. 1994
KAR 2115 [Flash movie] read with Public Interest
Litigation; filed by members of the Fraud Judges Society
in the name of Judicial Layout Residents & Site
Owners Association; in High Court of Karnataka WP No.

*In exercise of Section 76-N [031.S76N]
of Karnataka Town and Country Planning Act, 1961 and
other provisions of the said Act read with B.D.A. Act
and Land Revenue Act the Govt. cancels the Resolution
passed by B.D.A. [021.01][021.19s
] in favor of Fraud Judges Society namely Resolution
passed vide Subject No. 503/92 based on the Fraud Judges
Society's application dated 6th Nov. 1992. [021.01]
*The Sale Deeds [021.16][021.16s
] executed by or on behalf of Fraud Judges Society
on who-so-ever's name be and hereby stands cancelled as
all the said Sale Deeds deemed to having been Registered
fraudulently in accordance with Section 23 of The
Indian Contract Act, 1872.
*City Municipal Council (CMC) of Yelanka, Bangalore
be directed to cancel all the khathas opened in relation
to the sites formed in the illegal Judicial Layout based
on Fraudulent Sale Deeds.

*It is recommended in the interest of maintaining
probity in governance it is considered as a fit case to
be referred to CBI to investigate the affairs of the
Fraud Judges Society exercising the powers enshrined
under Article 258 A [033.258A]
and the investigations that was and is being made by Lok
Ayukta or Upa Lok Ayukta [023
] also be made over to CBI as the present Lok Ayukta and
his sub-ordinate judges on deputation are suspected to
be members and/or beneficiaries of Fraud Judges Society.
*The Advocate General is requested to file a Memo in
High Court of Karnataka for Transfer of cases namely WP
No.15101 of 2001 [023.27], WP
No.40994 of 2002 [040.02] and any other matters pending
by or against the Fraud Judges Society to the Supreme
Court of India with a request to club and hear the
matters along with the Fraud Judges Society's Special
Leave Petition No.12153 of 2000 [026.22][026.22A
] which is pending in Supreme Court in the interest of
free and fair trial of the cases.
*In accordance with All India Judges' Cases [037.01][037.02][037.02A
]; to keep Govt. of Karnataka free of High Court of
Karnataka; High Court of Karnataka be directed to
withdraw all Judicial Officers or Judges on deputation
to work in Govt. of Karnataka and its departments and
Authorities.
*Department of Personnel And Reforms (DPAR) be directed
to direct Karnataka Public Service Commission (KPSC) to
recruit Law Officers to serve permanently in Govt. as
its Employees.
*During the interregnum period Central Govt. may be
requested to spare Law Officers to work in place of
Judicial Officers or Judges on deputation from High
Court of Karnataka.
